I saw it again a couple of nights ago and again had the same feeling - I have no idea what the fascination is about. It is not a bad film, but I don't think it is something special either. Simply saying it is better than Gone with the Wind is silly, as Gone is a very weak film all around, not some standard of quality.
By 1939 MANY great films were already made, it is not like the movie industry was still unable to walk, and taken from that perspective the Hights is a naive and just an average effort.

Follow Ups:
It Happened One Night. By comparisson the Hights is so pretentious, so stuffy! It is like me playing Cinderella - out of place and out of period.

Now that is a real fun film, one of my favorite over the years. But almost all of Frank´s work is anyway..
Have you see " The lost Horizon " a very interesting essay, by the way.

I like this film.
The actors did a good work.
It has a kind of romantic halation that I do like. it is like a cozy place. Olivier was in a bad mood ( he wanted the female lead role for his dulcinea, Vivian but she would not get it..) so he let it down on Mrs. Oberon.
It is not the perfect film but one I like too look at.

I don't have any problem with someone liking that film - it is better than many. My concern is with putting it in some sort of high pedestal, as the pinnacle of cinematographic achievement of that time.Oliver's character was, BTW, confused and confusing. He was neither a protagonist nor antogonist, more like what some Ukranian would call a piece of horse manure in the barrel - floating around without any internal control. I felt he wasn't quite sure what to make of his character, and simply acted scene by scene.

Olivier by it self, with his romantic gloom, was a good show to look at but I felt the same as you did, I was uncomfortable.
For the rest I can notbut only agree.
